1. Who controls your data

The controller and operator of the Promotor Yachts website is Promotor Michał Mazurczak, a sole proprietorship owned by Michał Mazurczak, with its address at Skrajna 86C, 25-650 Kielce, Poland, NIP 6571967454.

2. Data we process

You can browse the public website without creating an account. We may process:

• information you provide when you contact us by email or telephone, such as your name, contact details and the content of your enquiry;
• information connected with a configurator enquiry or request for product information, including the selected boat model, version, engine, equipment, indicative total, reference number and submission time;
• technical connection, performance and security data generated by Cloudflare infrastructure, such as IP address, date and time, requested URL, HTTP and routing data, browser or device information, referrer, approximate country and server or security logs;
• aggregated website-use metrics produced by Cloudflare Web Analytics, such as page views, referrers, browser type, device type and country.

When you send a configurator enquiry, the contact details and configuration shown in the form are transmitted to Promotor and delivered to our dedicated business mailbox. The downloadable PDF is created locally in your browser and is not uploaded or separately stored by the website.

3. Purposes and legal bases

We process personal data only where a legal basis applies. Depending on the context, this may include:

• responding to enquiries, preparing a quotation and taking steps requested before entering into a contract (Article 6(1)(b) GDPR);
• our legitimate interests in operating, securing and improving the website, preventing misuse and communicating about the specific Promotor products you asked about (Article 6(1)(f) GDPR);
• compliance with legal obligations, including accounting, tax and consumer-protection requirements;
• your consent, where we expressly ask for it. You may withdraw consent at any time without affecting earlier lawful processing.

4. Recipients and international transfers

We use Cloudflare, Inc. and its group companies to provide DNS, content delivery, website hosting, traffic security, Turnstile bot protection and cookie-free Web Analytics. Cloudflare processes end-user IP addresses, traffic-routing data, system configuration and other request data to deliver and protect the website. Turnstile processes technical browser, device, network and interaction signals needed to distinguish legitimate visitors from automated abuse; Cloudflare states that it does not access form entries or other page inputs for this purpose. Cloudflare Web Analytics is configured without cookies or local storage and is intended to provide aggregated metrics rather than track individual visitors. Configurator enquiries are transmitted through Resend’s transactional-email service and delivered to configurator@promotoryachts.com, which is hosted using nazwa.pl infrastructure. Resend processes the destination and reply address, message content and delivery metadata for this purpose. Resend states that message content and related service data are stored in the United States. Data may also be made available where necessary to authorised team members, professional advisers and a relevant Promotor dealer, each only to the extent needed for their role.

Cloudflare, Resend and some other service providers may process information outside the European Economic Area. Where required, such transfers are protected by appropriate safeguards, including the European Commission’s Standard Contractual Clauses and, where applicable, participation in the EU–US Data Privacy Framework. Information about Resend’s safeguards is available in its Data Processing Addendum. You may contact us to request further information about the safeguards applicable to your data.

Links to Instagram, Facebook, YouTube, TikTok, Google Maps and dealer websites lead to services operated independently from Promotor. Once you open them, their own privacy terms apply.

5. How long data is kept

Configurator enquiries are normally retained in the dedicated mailbox for up to 12 months after the most recent contact. They may be kept longer where necessary to continue a business relationship, comply with legal duties or establish and defend legal claims. Technical, security and delivery data is retained according to the applicable Cloudflare, Resend and hosting-service settings. We avoid keeping identifiable data longer than necessary.

6. Your rights

Subject to the conditions of applicable law, you may request access to your data, rectification, erasure, restriction, portability or object to processing. Where processing relies on consent, you may withdraw it. You may also lodge a complaint with the Polish supervisory authority, the President of the Personal Data Protection Office (UODO).

7. Required information and automated checks

Providing your name, e-mail address and selected boat configuration is voluntary, but these details are required if you want to submit a configurator enquiry. Without them, the website cannot deliver the enquiry to our team. Providing a telephone number, country or additional message is optional. You may instead contact us directly by e-mail or telephone.

We do not use the enquiry data to make decisions that produce legal or similarly significant effects concerning you. Cloudflare Turnstile automatically evaluates technical security signals solely to prevent automated abuse. If a security check fails, the online form cannot be submitted, but you can retry it or contact us using the details in this policy.

8. Security and policy changes

We use proportionate organisational and technical measures intended to protect personal data. No online system is completely risk-free. This policy may be updated when website functions, providers or legal requirements change. The effective date at the top identifies the current version.

9. Contact
